Terms of Use — Enforso

These terms are an agreement between you and DOINGA LTD, a private company limited by shares registered in England and Wales (company number 17477068), whose registered office is at 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ, United Kingdom ("we"). They govern the Enforso app and the service behind it, and they are the app's licence agreement. By using Enforso you accept them.

Enforso is not a medical device

Enforso is a reminder service. It is not a medical device, it does not give medical advice, and it must not be relied on as the only safeguard for medication or anything else where a missed reminder could cause harm. A reminder reaches you only if Apple's notification service, your device and its settings, and your attention all work at that moment, and none of those is in our control. Keep whatever other safeguard your situation needs, and follow the advice of the people treating you.

Who may use Enforso

Enforso is for people aged 18 and over. By using it you confirm that you are.

The service

Enforso lets you create reminders and complete them by scanning a tag, a code or a compartment of a pill box, so that a reminder clears only when you have done the thing it is about. We may change, add or remove features, and we try to tell you in the app when a change affects how you use it.

Your account and your data

You can use Enforso on one device without an account, or sign in to keep your reminders across devices. You are responsible for what you put into Enforso and for keeping your devices secure. How we handle your data is described in the Privacy Policy; you can delete your account at any time.

Acceptable use

Do not use Enforso to break the law, to interfere with the service or other people's use of it, to probe or attack it, or to access data that is not yours. We may suspend or end access for anyone who does.

Paid access

Some features require paid access — a subscription or another paid option shown in the app. Before you buy, the app shows what you are buying, its price and, for a subscription, how long each period lasts and that it renews.

Apple is the seller. Purchases are made through the App Store and charged to your Apple account under Apple's terms.
Renewal and cancellation. A subscription renews automatically unless you turn renewal off at least 24 hours before the end of the current period, in your Apple account's subscription settings. Cancelling stops the next renewal; access continues to the end of the period you paid for.
Refunds are handled by Apple, under Apple's refund policy. We cannot issue App Store refunds ourselves.
Restoring purchases. If you reinstall the app or move to a new device, use Restore Purchases in the app to recover paid access bought with the same Apple account.
Free trials, where offered, convert to a paid subscription at the end of the trial unless you cancel before it ends.

Licence

We grant you a personal, non-transferable, non-exclusive licence to use the Enforso app on Apple-branded devices you own or control, as the App Store's usage rules allow. You may not copy, modify, reverse-engineer or redistribute the app except as the law permits regardless of these terms.

Apple

You and we acknowledge that:

these terms are between you and us, not Apple, and we, not Apple, are solely responsible for the app and its content;
Apple has no obligation to provide maintenance or support for the app;
if the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any; to the extent the law permits, Apple has no other warranty obligation, and any other claims, losses or costs are our responsibility, within these terms;
we, not Apple, are responsible for addressing any claims relating to the app or your use of it, including product-liability claims, claims that the app fails to meet a legal or regulatory requirement, and consumer-protection or privacy claims;
if a third party claims the app or your use of it infringes their intellectual property, we, not Apple, are responsible for the investigation, defence, settlement and discharge of that claim;
you are not located in a country subject to a United States government embargo or designated as supporting terrorism, and you are not on a United States government list of prohibited or restricted parties;
you must comply with the terms of any third-party service you use with the app;
Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

Liability

We provide Enforso with reasonable care and skill, but not every reminder can be guaranteed to arrive. To the extent the law allows, we are not liable for loss caused by a reminder that was late, missed or not acted on, or for indirect or consequential loss; and our total liability to you is limited to the amount you paid us in the twelve months before the claim. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or any other liability that cannot be limited by law, and nothing affects the rights you have as a consumer where you live.

Ending these terms

You can stop using Enforso and delete your account at any time. We may end or suspend the service, or your access to it, with notice in the app where we can give it; if we end the service as a whole, we will tell you how paid access is affected.

Changes to these terms

Each version carries a version number and the date it applies from. If a change materially affects you, we tell you in the app before it applies; continuing to use Enforso after that date means you accept the new version.

Law and disputes

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction over any dispute. If you are a consumer living elsewhere, you keep the protection of the mandatory law of your country, and you may bring proceedings where you live.
